Overview

Advin Servers is a hosting provider based in the state of Delaware in the United States. We do not host, control, or monitor the content our customers place on their servers. When we receive a valid request from a law enforcement agency, we will respond in accordance with applicable law and with our Privacy Policy. This page is intended for law enforcement agencies and legal professionals. If you are a customer, or you are reporting abuse originating from our network, please see our Abuse Policy instead.

Submitting a Request

All requests must be submitted in writing on official agency letterhead through our contact form or legal@advinservers.com. Please state clearly in the subject line that the request is a law enforcement request so that it is routed correctly. We do not accept legal process by telephone. Requests should include:
  • The name of the requesting agency and the badge, warrant, or case number
  • The name, title, and official contact details of the requesting officer
  • The specific IP address, service, or account identifier the request concerns
  • The precise date and time range of interest, including the time zone
  • A clear description of the records being sought
  • Any applicable non-disclosure order or preservation instruction
Requests that do not identify a specific service or time range cannot be processed. We are unable to conduct broad or open-ended searches of our systems. We generally comply with law enforcement in the United States and in the country where the service in question is physically hosted. Our servers are located in a number of countries, and the correct jurisdiction depends on the location of the service named in your request.
  • Subpoena or equivalent — basic subscriber and billing records
  • Court order — non-content records such as connection or access logs
  • Search warrant — content stored on a server, where such content is within our control
Foreign authorities seeking records held in the United States should proceed through a Mutual Legal Assistance Treaty (MLAT) request or letter rogatory. Requests concerning a server located outside of the United States should be directed through the appropriate authority in that jurisdiction.

Emergency Requests

If a request involves an imminent risk of death or serious physical injury, please mark it clearly as an emergency disclosure request and include a description of the emergency, the nature of the danger, and why the requested information is necessary to prevent it. We will review emergency requests as quickly as we are able, and may disclose information voluntarily where we believe in good faith that doing so is necessary to prevent the harm described.

Preservation Requests

We will honor a properly submitted preservation request and preserve the records we hold for 90 days pending the service of valid legal process, with one 90-day extension available on request. A preservation request by itself does not result in disclosure.

Information We Hold

The records available to us are limited. Depending on the service and the time period, we may hold account and billing information, payment records, ticket transcripts, and service provisioning records. Our data retention practices are described in our Privacy Policy. We do not retain customer traffic content, and we do not maintain full packet captures of customer traffic. On unmanaged services we do not hold customer server credentials, encryption keys, or the contents of customer disks in a form we can read. Records that have aged out of retention or that were never collected cannot be produced.

Content Complaints and Takedowns

We are not the publisher of content hosted by our customers. Complaints regarding specific content, including copyright claims, should be submitted through our Abuse Policy process. In most cases we will forward the complaint to the customer responsible and require a response within 24 hours. We will act directly on the service where the content is unlawful, where the customer fails to respond, or where we are required to do so by law.

Changes to the Policy

We may amend this policy from time to time. It is your responsibility to check for changes and make sure that you are up to date. We may send an email notice when major changes occur.
